Nationalstatslagen i A-studio

I YLE:s A studio (22.10.) behandlades nationalstatslagen som antogs i Israels parlament i juli.Programledaren Heikki Ali-Hokka kallade lagen för "kansalaisuuslaki". Nu är inte finska min starka sida men "kansalaisuus" betyder enligt ordboken "medborgarskap". På engelska kallas lagen "nation state law" inte "citizenship law".

Lagen talar överhuvudtaget inte om vem som har rätt till medborgarskap, ordet nämns inte (åtminstone inte i den engelska versionen) utan talar om Israel som judarnas nationalstat och vad det betyder i praktiken.

Heikki Ali-Hokka fotsätter och säger att "endast judar har rätt till israeliskt medborgarskap". Det är möjligt att Ali- Hokka inte läst lagen och bara grundar sina ord på det som reportern Sampo Vaarakallio säger i sitt reportage från Israel: "täysivaltainen kansalainen voi olla vain juutalainen" (bara en jude kan vara en fullvärdig medborgare). I vilket fall som helst är det en lögn har för fram.

Man får nästan varje vecka läsa om hur representanter från den etablerade nyhetsmedian skryter med hur det endast är de som levererar nyheter man kan lita på. Men ännu en gång visar det sig att det inte alls stämmer när man rapporterar från Israel.

I A-studios inslag brydde man sig inte om att berätta vad som egentligen står i lagen, inte heller ansåg reportern i Israel det värt att intervjua någon representant för Israels regeringen som kunde har förklarat lagens innehåll. Istället får man bland annat höra en israelisk arab beklaga sig över lagen och han verkar nog mera påverkad av den arabiska propagandan mot lagen än av vad lagen egentligen säger. Hans ord ger intryck av att man inte längre skulle få använda arabiska i Israel, och det är klart att det är ett bakslag för vilken minoritet som helst om ett minoritetsspråk fråntas sin officiella ställning. Men vad säger den nya lagen? Jo, det arabiska språket har fortsättningsvis specialstatus i Israel och hur arabiska skall användas i statliga institutioner skall specificeras i lag. Dessutom säger lagen att den inte skall skada den status som arabiska hade innan denna lag trädde i kraft. (Det skulle vara bra om lagstiftare kunde använda ett språk så att man förstår vad de menar!) I vilket fall som helst, arabiska har fortsättningsvis specialstatus i Israel och det är antagligen mer än vad man kan säga om många minoritetsspråk i Europa.

I studion fanns också  Outi Korhonen, professor i internationell rätt, tyvärr var hon väldigt försiktig i sina uttalanden. Kanske hon inte ville säga emot programledaren. Men hon omkullkastar nog ändå Ali-Hokkas och Vaarakallios uttalanden när hon helt riktigt säger att den nya lagen inte befattar sig med medborgarnas rättigheter på individnivå.

Den andra studiogästen, journalisten Hannu Reime, visade att han hade en del bakgrundskunskap. Han påpekade att lagen egentligen inte kommer med något nytt. T.ex. det att judar från världens alla hörn skall ha rätt att flytta till Israel är ingenting nytt. En lag som ger judar rätt att flytta till Israel har funnits från 1950-talet påpekade Reime.

Om A-studio hade för avsikt att ge en rätt bild av Israel och vad den nya lagen innebär misslyckades man totalt. Ville man svartmåla Israel lyckades man. Att man vill lyfta fram det som ett eventuellt brott mot mänskliga rättigheter att det är endast judar som har automatiskt rätt att flytta till Israel är obegripligt. Israel är judarnas hemland, det påpekade Tysklands förbundskansler Merkel när hon besökte Israel för några veckor sedan.
Israel är judarnas hemland, därför uppmanas judarna både i San Remo resolutionen och i stadgarna för Palestina mandatet att återvända och återskapa sin egen stat. När FN:s generalförsamling röstade för en delning Palestinamandatet 1947 var förhoppningarna en judisk stat och en arabisk.

Det borde inte vara svårt, varken för journalister eller politiker, att acceptera att judarna har rätt till en egen stat, men det är det, väldigt svårt.
Eftersom Israel är judarnas hemland är det naturligt att judar från hela världen skall ha rätt att flytta dit. Det är absurt att antyda att då borde också alla andra ha rätt att flytta dit!

Ett seriöst inslag borde ge tittarna information om att både Israels självständighetsförklaring och tidigare antagna lagar säger att alla medborgare i Israel, oberoende av ras eller religion, har fulla medborgerliga rättigheter... och att den nya lagen inte alls pratar om medborgerliga rättigheter utan om vad den judiska nationalstaten är.

Basic Law: Israel as the Nation-State of the Jewish People
1 — Basic principles
A. The land of Israel is the historical homeland of the Jewish people, in which the State of Israel was established.

B. The State of Israel is the national home of the Jewish people, in which it fulfills its natural, cultural, religious and historical right to self-determination.

C. The right to exercise national self-determination in the State of Israel is unique to the Jewish people.

2 — The symbols of the state

A. The name of the state is “Israel.”

B. The state flag is white with two blue stripes near the edges and a blue Star of David in the center.

C. The state emblem is a seven-branched menorah with olive leaves on both sides and the word “Israel” beneath it.

D. The state anthem is “Hatikvah.”

E. Details regarding state symbols will be determined by the law.

3 — The capital of the state

Jerusalem, complete and united, is the capital of Israel.

4 — Language

A. The state’s language is Hebrew.

B. The Arabic language has a special status in the state; Regulating the use of Arabic in state institutions or by them will be set in law.

C. This clause does not harm the status given to the Arabic language before this law came into effect.

5 — Ingathering of the exiles

The state will be open for Jewish immigration and the ingathering of exiles

6 — Connection to the Jewish people

A. The state will strive to ensure the safety of the members of the Jewish people in trouble or in captivity due to the fact of their Jewishness or their citizenship.

B. The state shall act within the Diaspora to strengthen the affinity between the state and members of the Jewish people.

C. The state shall act to preserve the cultural, historical and religious heritage of the Jewish people among Jews in the Diaspora.

7 — Jewish settlement

A. The state views the development of Jewish settlement as a national value and will act to encourage and promote its establishment and consolidation.

8 — Official calendar

The Hebrew calendar is the official calendar of the state and alongside it the Gregorian calendar will be used as an official calendar. Use of  the Hebrew calendar and the Gregorian calendar will be determined by law.

9 — Independence Day and memorial days

A. Independence Day is the official national holiday of the state.

B. Memorial Day for the Fallen in Israel’s Wars and Holocaust and Heroism Remembrance Day are official memorial days of the State.

10 — Days of rest and sabbath

The Sabbath and the festivals of Israel are the established days of rest in the state; Non-Jews have a right to maintain days of rest on their Sabbaths and festivals; Details of this issue will be determined by law.

11 — Immutability
This Basic Law shall not be amended, unless by another Basic Law passed by a majority of Knesset
